ModLog – Moderation Suite for Streaming Platforms

§ 1 Scope and Contracting Parties
1.1 These Terms of Service (hereinafter "Terms") govern the use of services offered by ModLog UG (haftungsbeschränkt), Rheinstr. 20, 36124 Eichenzell, Germany, registered in the Commercial Register of the Fulda District Court under HRB 9174 (hereinafter "ModLog", "we" or "us").
1.2 ModLog comprises a web-based dashboard, a Discord bot, and a Twitch bot (collectively the "Service" or "Services"). Additional platforms such as YouTube, Kick, and others may be added in the future.
1.3 These Terms apply to all users of the Service (hereinafter "User" or "you"). By registering for or using the Service, you agree to these Terms.
1.4 Deviating terms and conditions of the User shall not be recognized unless ModLog expressly agrees to their validity in writing.
§ 2 Service Description
2.1 ModLog is a software suite for moderators and streamers on streaming platforms. The Service includes, but is not limited to:
- Retrieval and display of moderation statistics
- Chat moderation and logging features
- Management of moderator privileges (appointing/removing moderators and VIPs)
- Custom commands
- Additional features that may be added from time to time
2.2 The specific scope of features may vary depending on the selected plan. ModLog reserves the right to modify, expand, or restrict features at any time.
2.3 ModLog is provided "as is" and "as available". We do not guarantee any specific availability or functionality.
§ 3 Registration and User Account
3.1 Use of the Service requires registration. Registration is performed via Twitch OAuth. For certain features, additional Discord OAuth authentication may be required.
3.2 The minimum age for using ModLog is 16 years. By registering, you confirm that you are at least 16 years old.
3.3 By registering via OAuth, you consent to ModLog accessing certain data from your Twitch and/or Discord account as described in our Privacy Policy.
3.4 You are obligated to keep your access credentials confidential and protect them from third-party access. If you suspect misuse of your account, you must immediately notify us at [email protected].
3.5 Each user may only maintain one account. Creating multiple accounts to circumvent restrictions or for other reasons is prohibited.
§ 4 Third-Party Terms of Service
4.1 ModLog uses APIs and services from third-party providers, particularly the Twitch API and the Discord API. By using ModLog, you also agree to the applicable terms of service of these third-party providers:

4.2 Additional third-party APIs may be added in the future (e.g., YouTube API, Kick API). The corresponding terms of service will then apply accordingly.
4.3 ModLog is not an agent or representative of the aforementioned third-party providers and has no special business relationship with them.
§ 5 Prices and Payment Terms
5.1 ModLog offers various plans:
- Free (€0.00 / month)
- Premium (€11.99 / month)
- Premium Plus (€34.99 / month)
5.2 The stated prices are final prices. If VAT applies, it is included in the price.
5.3 The specific scope of features for each plan is displayed on the website and may change from time to time.
5.4 Payment processing is handled through Stripe (Stripe Payments Europe, Ltd.). By using paid plans, you accept Stripe's terms of service.
5.5 Paid subscriptions automatically renew for the respective billing period unless canceled before the end of the current period.
§ 6 Trial Period
6.1 A free trial period of 14 days may be offered for paid plans.
6.2 After the trial period expires, the subscription automatically becomes paid unless canceled beforehand.
6.3 The trial period may only be used once per user.
§ 7 Cancellation and Refunds
7.1 Free accounts may be canceled at any time by contacting [email protected].
7.2 Paid subscriptions may be canceled at any time effective at the end of the current billing period via the dashboard or through Stripe.
7.3 Refunds of amounts already paid are generally not provided, as these are digital services that are made available immediately upon receipt of payment.
7.4 Statutory withdrawal rights for consumers remain unaffected (see Section 15).
§ 8 Permitted Use
8.1 ModLog may only be used for the following purposes:
- Moderation of streaming channels and associated communities
- Retrieval and analysis of moderation statistics
- Management of moderators and community members
- Other intended use of the offered features
8.2 Commercial use of ModLog is permitted.
§ 9 Prohibited Use
9.1 The following is prohibited when using ModLog:
- Violation of applicable law, particularly criminal law
- Distribution of illegal, offensive, discriminatory, violence-glorifying, or pornographic content
- Spam, harassment, stalking, or other harassment of other users
- Reverse engineering, decompilation, or disassembly of the software
- Exploitation of security vulnerabilities, hacking, or other attacks on infrastructure
- Automated data extraction (scraping) without express permission
- Circumvention of security measures or access restrictions
- Introduction of malware, viruses, trojans, or similar
- Infringement of copyrights, trademarks, or other third-party rights
- Deception about one's identity or fraudulent behavior
- Any other use that contradicts the purpose of the Service
9.2 ModLog reserves the right to suspend or delete user accounts without warning for violations of these provisions.
§ 10 User-Generated Content
10.1 Users may create their own content, particularly custom commands and messages (hereinafter "User Content").
10.2 The User is solely responsible for all User Content they create. ModLog assumes no responsibility for User Content.
10.3 The User grants ModLog a simple, temporally and spatially unlimited right of use to User Content, insofar as this is necessary for the operation of the Service.
10.4 ModLog reserves the right to remove, edit, or block User Content at its own discretion, particularly if it violates these Terms or applicable law.
§ 11 Intellectual Property
11.1 All rights to ModLog, including software, source code, databases, graphics, logos, texts, and other content, belong exclusively to ModLog or its licensors, unless otherwise indicated.
11.2 Use of ModLog does not grant the User ownership or other rights to the software, but merely a limited, non-transferable right of use for the duration of the contractual relationship.
11.3 "ModLog" and associated logos are trademarks of ModLog UG (haftungsbeschränkt). Use without express permission is prohibited.
§ 12 Data Protection and Data Storage
12.1 Personal data is collected and processed as part of using ModLog, including:
- Username (Twitch, Discord)
- Email address
- IP address
- OAuth tokens (access and refresh tokens)
- Moderation statistics and related data
12.2 All data is stored on servers in Germany.
12.3 Currently, only system-essential cookies are used. Data is not shared with third parties unless necessary for service provision (e.g., payment processing via Stripe).
12.4 Users may request information about their stored data by sending an email to [email protected].

§ 13 Liability
13.1 ModLog is liable without limitation for damages arising from injury to life, body, or health, as well as for damages caused intentionally or through gross negligence.
13.2 In cases of slight negligence in breach of essential contractual obligations (cardinal obligations), liability is limited to foreseeable, contract-typical damages.
13.3 Otherwise, ModLog's liability is excluded to the extent permitted by law. This applies particularly to:
- Damages due to downtime or technical disruptions
- Data loss
- Damages caused by User Content or actions of third parties
- Indirect damages or lost profits
13.4 ModLog does not guarantee any specific availability of the Service. Planned maintenance will be announced in advance when possible.
13.5 ModLog is not liable for content created or distributed by users through the Service.
§ 14 Suspension and Termination by ModLog
14.1 ModLog is entitled to temporarily or permanently suspend or terminate user accounts if:
- The User violates these Terms
- The User violates applicable law
- The security of the Service or other users is at risk
- There are legitimate concerns about fraud or abuse
- This is required for legal reasons
14.2 Upon suspension or termination, user data will be deleted after 30 days, unless statutory retention obligations apply.
14.3 No refund is due for suspension or termination resulting from User violations.
§ 15 Right of Withdrawal for Consumers (EU)

Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the date of contract conclusion.
To exercise your right of withdrawal, you must inform us (ModLog UG (haftungsbeschränkt), Rheinstr. 20, 36124 Eichenzell, Germany, Email: [email protected]) of your decision to withdraw from this contract by an unequivocal statement (e.g., a letter sent by post or email).
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of Withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, without undue delay and no later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will use the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise.
If you requested that the services begin during the withdrawal period, you shall pay us an amount proportional to the services already provided until you communicated your withdrawal from this contract, compared to the full scope of services under the contract.
Special Note:
The right of withdrawal expires for a service contract when the service has been fully performed, if performance began with your prior express consent and acknowledgment that you would lose your right of withdrawal upon full performance of the contract by us.
§ 16 Changes to These Terms
16.1 ModLog reserves the right to modify these Terms at any time. Changes will be published on the website and announced via the dashboard and Discord server.
16.2 Changes become effective upon publication. Continued use of the Service after publication of changes constitutes acceptance of the modified Terms.
16.3 If you do not agree with the changes, you may terminate the Service.
§ 17 Communication and Support
17.1 The following channels are available for support inquiries and general communication:

17.2 By using the Service, you agree that we may contact you via the provided contact information about changes to the Service, Terms, or other relevant information.
§ 18 Final Provisions
18.1 The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers residing in the EU, mandatory consumer protection provisions of their country of residence additionally apply.
18.2 If the User is a merchant, legal entity under public law, or special fund under public law, the place of jurisdiction for all disputes arising from this contractual relationship is Fulda, Germany.
18.3 Should individual provisions of these Terms be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. In place of the invalid or unenforceable provision, a valid provision shall apply that comes closest to the economic purpose of the invalid or unenforceable provision.
18.4 These Terms were drafted in German. An English translation is additionally provided. In case of contradictions between the German and English versions, the German version shall prevail.
